  4. ASP OMBUDSMAN INFORMATION

  6. Just For Me Software is a member of the Association of 
  7. Shareware Professionals (ASP).  ASP wants to make sure that 
  8. the shareware principle works for you.  If you are unable 
  9. to resolve a shareware-related problem with an ASP member 
  10. by contacting the member directly, ASP may be able to help. 
  11. The ASP ombudsman can help you resolve a dispute or problem 
  12. with an ASP member, but does not provide technical support

  23. ASP AUTHOR STANDARDS  
  24.   
  25. 1.)  ASP-compliant products are shareware products, produced 
  26. by ASP Author Members or published by ASP Publisher Members, 
  27. that satisfy all the requirements of this document.  Only 
  28. ASP-compliant products may use the ASP logo or Ombudsman 
  29. statement.  Only ASP-compliant products may refer to ASP -- 
  30. whether in the product, documentation, or marketing 
  31. materials -- in any way that might reasonably be interpreted 
  32. as suggesting ASP compliance.  ASP-compliant shareware 
  33. products must be created and marketed in a professional 
  34. manner and must treat the use of the software and the 
  35. concept of shareware with courtesy and respect.

  38. 2.)  An ASP-compliant product may limit the user evaluation 
  39. period.  If such limitations are used, the product must 
  40. allow users access to the features customary or reasonable 
  41. for that type of product for a time period or number of uses 
  42. sufficient to allow adequate evaluation by the user.  An 
  43. ASP-compliant product may also use other limiting measures. 
  44. Such measures must not unduly interfere with the evaluation 
  45. of the product.  All limiting measures must be documented. 
  46. Users must be notified, while using the program, or the 
  47. impending expiration of the evaluation period.  This 
  48. notification must occur well in advance of any disabling 
  49. of features or cessation of program operation.  Users 
  50. obtaining the shareware version of an ASP-compliant product 
  51. from any source approved by the author must be able to 
  52. install and use the product for the full evaluation period.                                   -- 2 --

  54. 3.)  Registration Reminder Screens may be used in an 
  55. ASP-compliant product.  Such Registration Reminder Screens 
  56. must not unduly interfere with the evaluation of the product 
  57. during the initial evaluation period.  
  58.   
  59. 4.)  An ASP-compliant product must be substantially complete, 
  60. and accurately represent the registered version, except in 
  61. cases where a substantially complete product would provide 
  62. little or no reason for the user to register and pay for the 
  63. product.  Examples include some games, source code for 
  64. programmer's tools, electronically published books, fonts, 
  65. and clip art collections.  In those cases, a portion of the 
  66. product allowing adequate evaluation of the product may be 
  67. distributed.  A Non Shareware Version (NSV) of the product, 
  68. which includes advanced features, may also be offered, in 
  69. addition to the normal registered version.  
  70.   
  71. 5.)  When, during evaluation of an ASP-compliant product, a 
  72. user creates data that have substantial independent value, 
  73. the product shall not prevent some form of access to those 
  74. data even after the expiration of the evaluation period. 
  75. Such access may or may not require further use of the 
  76. product itself.  
  77.   
  78. 6.)  An ASP-compliant product must include some form of 
  79. documentation sufficient to allow thorough evaluation of 
  80. the program's features.  Such documentation must explain 
  81. how to register and pay for the product and define the 
  82. benefits of payment and registration.  It must also describe 
  83. any evaluation limitations and differences between the 
  84. shareware and registered versions.  This documentation must 
  85. also describe support policies and include the current ASP 
  86. Ombudsman statement.  
  87.    
  88. 7.)  An ASP-compliant product must offer some method or 
  89. instructions for safely removing the product from the user's 
  90. computer.  
  91.   
  92. 8.)  ASP-compliant products must offer reasonable technical 
  93. support for a minimum of three months after the purchase and 
  94. registration of the program, without additional payment.  
  95.   
  96. 9.)  An ASP-compliant product must be conscientiously tested 
  97. by the author, and should not be harmful to user data or 
  98. hardware when properly used on a typical computer.  
  99.   
  100. 10.)  All ASP Authors or Publisher Members must market and 
  101. distribute at least one ASP-compliant product.  They may 
  102. also market and distribute products which are not 
  103. ASP-compliant, subject to the limitations of Item 1 of this

  106. 11.)  Authors or Publishers applying for membership to the 
  107. ASP shall submit a product for examination by the ASP Author 
  108. Membership Committee.  This product must meet all 
  109. requirements in this policy before membership is granted. 
  110. Negative decisions of the Author Membership Committee shall 
  111. be automatically reviewed by the ASP Board of Directors, 
  112. whose decision is final.  An author whose application is 
  113. rejected may reapply at any time. 
  114.   
  115. 12.)  All products marketed as ASP-compliant must meet the 
  116. requirements of this policy.  The ASP Author Compliance 
  117. Committee (ACC) is entrusted to make the sometimes difficult 
  118. judgments involved in enforcing these requirements.  If 
  119. the ACC finds that an ASP member's product violates these 
  120. requirements, that member must modify the product to comply, 
  121. or must remove all indications of compliance.  If the member 
  122. refuses to make these changes within 30 days (or a longer 
  123. alternate period set by the ACC), the ACC may terminate 
  124. the member's ASP membership, subject to automatic review by 
  125. the ASP Board of Directors.

  127. 13.)  The ASP Board of Directors may not materially change 
  128. items in this policy, but may, from time to time, explain, 
  129. interpret, or clarify these policies.
